Law no. 278/2020 for the approval of the Government Emergency Ordinance no. 147/2020 on granting days off for parents in order to supervise children, in case of limitation or suspension of teaching activities that involve the actual presence of children in schools and early childhood education units, following the spread of SARS-CoV-2 coronavirus
Romanian Parliament adopted the law approving the ordinance on days off granted to parents for the supervision of children
Amendments to the conditions that parents must accomplish cumulatively:
- in order to grant days off to one of the parents for the supervision of the children, to the conditions provided by art. 1 para. (2) of the O.U.G. no. 147/2020, is added the condition that the workplace does not allow work at home or telework.
Exceptions on granting days off in order to supervise the children:
- as an exception, benefits from the provisions of the O.U.G. no. 147/2020 the parent or legal representative whose child, up to 12 years of age, enrolled in a school education unit or in a early learning unit, suffers from a chronic illness, regardless of whether the teaching activities were or were not limited or suspended as a consequence of the result of the epidemiological investigation caused by the spread of the SARS-CoV-2 coronavirus, provided that the other parent does not, in turn, benefit from days off;
- as an exception to the rule that the employer is obliged to grant days off if the employee requests this right according to the O.U.G. no. 147/2020, employees in the units of the national energy system, in the operating units in the nuclear sectors, in the units with continuous fire, in the units of social assistance, of telecommunications, of the public radio and television, in the railway transport network, in the units providing public transport and local sanitation service, supply of gas, electricity, heat and water to the population, from food trade units, financial services, fuel distribution, production and distribution of medicines and sanitary equipment, as well as staff from pharmaceutical units, benefits from the provisions of the O.U.G. no. 147/2020 only with the consent of the employer.
Specifications regarding the employees of the national defense system, public order and national security, the employees from the penitentiaries and the staff from the public health units:
- if one of the parents carries out his / her activity in the national system of defense, public order and national security or is employed in penitentiaries or public health units, he is entitled to an increase in addition to the due salary entitlements, in the amount of 75% of the basic salary / official salary / the payment corresponding to a working day, but not more than the daily correspondent of 75% of the average gross salary used to substantiate the state social insurance budget, corresponding to the number of working 2 days during the period of limitation or suspension of teaching activities as a consequence of the result of the epidemiological investigation determined by the spread of the SARS-CoV-2 coronavirus, provided that the other parent does not benefit from days off. If both parents work in one of the areas mentioned above, only one of them is entitled to the increase granted, in addition to the due salary rights.
